Terms & Conditions

Until you start working with us please carefully read and understand our terms and conditions.

Please keep in mind that TechOverload reserves its right to update / alter our terms and conditions without notice or warning at any time.

Project Terms

  • Both estimates / citations are based on our interpretation of your criteria and according to your particular time frame. Any interface changes, including micro-improvements, can increase costs at our editing rate of 500 Rs. per day. In a face-to-face or WhatsApp interaction please make to explain your expectations and layout for the website.

  • In approving a quote, you agree and adhere to TechOverload's terms and conditions. Acceptance maybe physical, via email, deposit payment or through signing a quote or getting in touch with us.

  • Clients must ensure that all criteria are included in the quotes / proposals / estimates so that we fully understand their needs. Customers will give us clear instructions along with the motion or detailed information that they can need. When we do not have these information, we will continue with our interpretation of the specifications and quote accordingly. When a difference exists, the adjustment of the changes will result in additional costs. Thus, it is important that you explain every aspect of the creation of your website and ensure that you are quoted on the right requirements.

  • Any uncertainly relating to particular activities must be notified in advance and included in the budgetary purposes proposal. We work in good faith and rely on our customers to divulge the full picture at quotation time. TechOverload will not bear any imbalance that arises as a result of unclear requirements.

  • Every role is allocated minimal man-hours including Project Management, Development and Editing. Subtle changes can be included within the time allotted. This is evaluated on a case-by case basis

  • Within the specified timeline, TechOverload will make every effort to complete the project / adjustments. If the functional requirements are reshaped or changed, rational delays are acknowledged.

  • Any disruptions at the end of the client could postpone the design and the timelines planned and may increase the cost.

  • Any overhaul on a job that has already been completed would incur additional charges of 500 Rs. per hour. Any changes to the specification would mean extra charges after the getting approval.

  • Any changes required during the production or after the site is released would charge additional fees. Any extra work is paid individually, over and above the forecasts. TechOverload will in no conditions be responsible for any delays caused by a shift in the project brief.

  • The design of the website and all related materials must be given to us within the one week of project commencement. Any delays subsequently may prolong the project and may incur extra costs if they go past a fair timeline.

  • As a general rule, our websites are checked on MACs and PCs and provide nearly current editions of the following browsers : IE, Firefox, Chrome & Safari. If screening on any other browser is necessary, please let us know in advance.

  • Web pages compliant with mobile / multi-device apps are reviewed on iPhone and iPads. If you need to do testing on some other computer, please discuss it beforehand.

  • Please notice that stalling the project for more than two calendar months would incur 500 Rs. per month administration costs at any point during the project. Additionally, it may increase estimates previously approved. If you request that the project be delayed, please let us know in advance in writing. We would need the account to be up to date to place the project on hold without additional charges.

  • The website design work of TechOverload is the exclusive property of TechOverload. TechOverload does not, in any conditions, permit the design to be used for re-sale as models or reproduction purposes without prior consent.

  • The website will be built on WIX and set up for deployment on the web, using the web-server and framework of WIX.

  • Based on the features required, modules from third parties, such as Third Party Payment Gateways or SSL certificates can be involved in building the WIX website. Even though TechOverload does it utmost to consider the appropriateness of any such product, any unexpected limitations of components from third parties are just beyond our influence. Any procurement costs of third-party components (such as SSL, Payment Gateway, Google Adwords, Plug-In Licenses etc.) or extra WIX charged for applications will be beared by the client.

  • The customer must understand that unexpected events that often delay the design process, especially with respect to the implementation of apps or software from third parties. We'll do our utmost to complete the project as stated in the contract and keep the client up-to-date, If any delay occurs. As long as it is within a fare timeframe, the customer shall agree that we shall not be penalized for any actual delay if every attempt is taken to maintain the project within the purposed timeline.

  • Fees for domain registration / renewal etc are not included as part of any design / proposal unless otherwise specified. If necessary, a quote will be submitted separately for which the client will approve.

  • If otherwise indicated, hosting fees are not included in the quotations. If required, TechOverload will arrange a suitable hosting solution through WIX for which a quote must be submitted separately and accepted by the customer.

  • All communications / contact is usually made via emails. This is the duty of the client to keep us posted with their email addresses in question.

General Approach

We apply the following steps for general website design & editing projects :

  • A 50% deposit payment is processed at quote acceptance / signoff to book in the build and start the project. This deposit would be non-refundable.

  • When we have all the client info, such as logo, photos, branding materials etc and specific details of the editing work or layout you have requested along with design samples of websites you want, we will have a mock-up for your evaluation within 5-10 working days.

  • You should review the concept accordingly and suggest changes. We give a five-round of free edits per page, depending on your project.

  • Once the design has been finalized and approved, we will set up the site's mobile version.

  • After the mobile version of the site has been accepted and If necessary, we will allow you to give us 10 SEO keywords that you would like your site to found in Google and other search engines. We will use these as the basis for setting up the simple WIX SEO. Our configuration will be shared with you via email and any changes will be made accordingly.

  • When the website is ready for the publication from our side we will give you the final payment invoice.

  • Please know that we demand full payment before website is released or sent to your WIX account.

  • Please notice, the project has restricted man-hours allocated to it. The projections are based on the premise that tasks will be finished within 8 working weeks depending on the size of the project. Any more delays could increase the costs of project management. If you do not think the project is done within this timeline, please let us know before project begins.

  • This also takes a lot of times to go back and forth, in general. At the beginning of the project, we urge you to include all the required information to ensure that the time of the project team is spent wisely on your project and that you do not create unnecessary extra costs.

  • As needed by the project, you will be updated regularly via emails and or phone calls. Nonetheless, please feel free to contact us anytime you need project status. Keep us posted with your respected email addresses and contact information too.

  • If the website / application is made live on the domain of the customer, it is their duty to make changes and upgrade all components and softwares of third parties.

Payment & Refund Terms

Payment Terms

  • All rates shall be quoted in INR unless demanded otherwise.

  • All invoices shall be issued according to schedule using your chosen payment form. We accept payment only via PayU, Bank Transfer,  International Bank Transfer or through PayPal. Payments are not approved via Cryptocurrency.

  • An admin surcharge is paid for PayPal rendered payments.

  • Milestone payments shall be made within 5 working days of each milestone / schedule, except where mutually agreed. The final payment must be made before going live on the website / application / project.

  • Payment receipt is considered to be acceptance of quotation, achievement, completion, mission, and terms and conditions.

Refund Terms

  • Remember that all sales are final.

  • The process of development of the Web View Application will take 24 days to complete. After that, we will submit your application to Google Playstore. Google Playstore provides 3 attempts to make the App live. The violation of any of the google policies will result in failure of making the Application live. We will from our side try our best to have a workaround & get the application live (NO COMMITMENTS). If Google Playstore rejects your website after the 3rd time too.  We will initiate a refund. There will be no refund processed in any situation apart from the scenario given above for Webview Android App.

  • Our editing services offer no refunds. The deposits of 50% are non-refundable for design research. Refunds for the remaining construction costs are only available for a span of 7 days following payment of the security payment. Refund requests made after the initial project start period of 7 days won't be considered. Refunds on 

  • TechOverload has the authority to offer and refund a reasonable portion of the fee paid to the requested service by the customer.

  • If you cancel your order after making the payment but the work has not begun, we will refund 75% of the payment you have already made. If the order is canceled after work has finished, the maximum refund or fee of the invoice would be 50%. There will be no refund or modification if cancelation is called after more than 50% of the job is done or if any request for refund is made after the 28 day span after the actual beginning of the project work.

  • All cancelations must be sent in writing and submitted via email. Telephone cancelation requests won't be approved.

Refunds are processed to the respective bank in a period of 7-14 working days for India & upto 45 days for International Payments. 

Additional Payment Terms

  • Payments must be made either in advance or as per the terms specified in the invoice / proposal for minor or once-off works, such as editing services. All payments should be made in full and no refunds are available for these types of plays. If you need any changes to the terms and conditions, you must contact us in writing (accepted e-mails) within two working days of receiving the same.

  • Late payments and penalties: from the due date, all outstanding invoices will incur a late payment charge of 10% of the unpaid amount and an administration fee of 5% interest per month.

  • If you are late with a payment or have any questions about the Invoice, please contact us immediately upon receipt of the invoice or e-mail reminder.

  • All communications / contact is usually made via emails. This is the duty of the client to keep us posted with their email addresses in question.

  • Any charge relating to the maintenance or hosting of the domain name registration or any third party goods or services obtained on behalf of the customer shall be payable in full and shall not be refundable. We must be told at least 30 days before the renewal date in case of any renewal cancellations.

  • In our own WIX Pro accounts, TechOverload typically creates and checks WIX websites. Only after complete payment of all invoices and fees will the website be moved to the client's WIX account.

Due Date : Is the date with which payment is due according to the invoice / proposal conditions.

Unpaid Invoice : An invoice shall be declared to be unpaid if the bill is still due after 14 days after the due date expires.

Deficit Collection : A further 7 days after the late payment charge is levied for payment of the invoice is charged to customer. The non-payment would result in the outstanding balance going to a debt collector. Techoverload shall not be liable for any costs or charges relating to the recovery of the outstanding amount. Any charges associated with recovery (debt collectors, administration) of the outstanding amount charges, legal fees) shall be returned to the customer for payment.

Dispute, Liability & Indemnity

  • In the case of a dispute, TechOverload retains the right to compensate the client in full for the work completed, as well as the time expended on dispute resolution. During such a case, TechOverload reserves the right to charge the consumer without following any previously accepted discounts during good faith. TechOverload would not be liable in any conditions for any losses incurred by misrepresentation or misinformation.

  • TechOverload maintains the right to deny service to any customer if it is not in accordance with our values and policies of business activity.

  • TechOverload offers its services as they are, without any security guarantees or other issues leading to data loss, sale or reputation. We guarantee that our systems and servers are protected against hackers, viruses, intruders and other online and offline issues to the best of our ability, but we will not be held accountable for any technical glitch if such situation arises.

  • TechOverload's relationship with its vendors, associates and subcontractors is unique in character. None of the parties has the power, right or jurisdiction to intervene or bind the other, or to assume or establish the duty or liability, whether expressed or implied, on behalf of the other or in the name of the other.

  • The Company shall indemnify and keep TechOverload its Licensors, Content Providers, Service Providers, Staff, Commissioners, Officers, Directors, Contractors and Subcontractors (the "Indemnified Parties") safe from the violation of any of these Terms and Conditions or any other terms, conditions, policies or procedures, including, without restriction. Client accepts that the indemnified parties will not be responsible for any such violation or illegal use, and you promise to indemnify and keep the indemnified parties safe from any and all of them the potential injuries, claims, penalties, compensation, charges, expenses and attorney's fees related to them. You must therefore indemnify and protect the Indemnified Parties against any allegations made by third parties resulting from the use of the information collected from TechOverload.

  • TechOverload shall not be responsible for any breach of the contract caused by any matter outside its reasonable control, including but not limited to God's Law, fire, lightning, explosion, war, disorder, global pandemics, flooding, earthquake, industrial disputes (whether or not involving its employees), extreme weather, or acts of local or central government or other competent authority.

Intellectual Property

  • If otherwise stated, all content on this website is TechOverload property. TechOverload reserves the right to alter the content or policies without prior notification.

  • The intellectual copyrights related to the project are transferred to the client after complete project payment has been made and the web is transferred to the client and/or published online. TechOverload holds the right to deny ownership transfer if there are unusual circumstances.

  • The copyrights handed over to the customer do not include rights to recycle the design features for another website or to try to sell the design as templates or personal design elements for any commercial or non-commercial purpose.

  • Without written permission from us, clients, partners, suppliers, subcontractors and any other third party company or entity may not use TechOverload branding including name, logo and icon in any form or shape.

Privacy Statement

What do we do with your information?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

When you browse our store, we also automatically receive our computer's Internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

Consent

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

How do I withdraw my consent?

If after yo opt-in you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at care@techoverload.org.

Disclosure

We may disclose you personal information if we are required by law to do so or if you violate our Terms of Service.

Payment

We use RazorPay for processing payments. We/RazorPay do not store your card data on their servers. The data is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS) when processing payment. Your purchase transaction data is only used as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is not saved.

Our payment gateway adheres to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brads like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and it's service providers.

Third-Party Services

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide them for your purchase-related transactions.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or it's facilities are located.

Once you leave our store's website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website's Terms of Service.

Links : When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

Security

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

Cookies

We use cookies to maintain session of your user. It is not used to personally identify you on other websites.
